Limitation On Our Liability And Liabilities Not Assumed
Domestic: Our domestic liability for loss or damage to your shipment is limited to $50.00 or $.50 per pound of the lost or damaged package whichever is greater. Unless prior arrangements have been made within our main office to purchase additional insurance at $1.25 per $100.00 of value declared, and paid in advance. If a higher value is declared and the additional charges are paid, our liability will be the lesser of your declared value per piece or the actual value of each piece, as outlined in detail on airbill at time of pick up.
International: Our international liability for loss or damage to your shipment is limited to U.S. $100.00 per shipment. Unless prior arrangements have been made within our main office to purchase additional insurance at $1.25 per $100.00 of value declared, and paid in advance. If a higher value is declared and the additional charges are paid, our liability will be the lesser of your declared value per piece or the actual value of each piece, as outlined in detail on airbill at time of pick-up.
In no event will we be liable for any damages. whether direct, indirect, incidental, special, exemplary, or consequential, including, but not limited to loss of income or profits, in excess of the declared value of a shipment, regardless of whether on the go cargo had any knowledge that such damages might be incurred.
We will not be liable for your acts or omissions, including but not limited to improper or insufficient packaging, securing, marking or addressing, or for the fact or omissions of the recipient or anyone else with an interest in the package. Also, we will not be liable if you or the recipient violates any of the terms of our agreement.
We will not be liable for loss of or damage to shipments of cash, currency or other prohibited items. We shall not be liable for the transportation of bonds, jewelry, precious stones, fine art, bullion, valuable papers or other articles of significant value nor for damage to any article improperly packaged to withstand ordinary handling.
We will not be liable for loss, damage or delay caused by events we cannot control, including but not limited to acts of god, perils of the air, weather conditions, mechanical delays, acts of public enemies, war, strikes, civil commotions, or acts or omissions of public authorities ( including custom and quarantine officials) with actual or apparent authority.
