Limitation On Our Liability And Liabilities Not Assumed
Domestic: Our domestic liability for loss or damage to your shipment is limited to $50.00 or $.50 per pound of the lost or damaged package whichever is greater. Unless prior arrangements have been made within our main office to purchase additional insurance at $1.25 per $100.00 of value declared, and paid in advance. If a higher value is declared and the additional charges are paid, our liability will be the lesser of your declared value per piece or the actual value of each piece, as outlined in detail on airbill at time of pick up.
International: Our international liability for loss or damage to your shipment is limited to U.S. $100.00 per shipment. Unless prior arrangements have been made within our main office to purchase additional insurance at $1.25 per $100.00 of value declared, and paid in advance. If a higher value is declared and the additional charges are paid, our liability will be the lesser of your declared value per piece or the actual value of each piece, as outlined in detail on airbill at time of pick-up.
In no event will we be liable for any damages. whether direct, indirect, incidental, special, exemplary, or consequential, including, but not limited to loss of income or profits, in excess of the declared value of a shipment, regardless of whether on the go cargo had any knowledge that such damages might be incurred.
We will not be liable for your acts or omissions, including but not limited to improper or insufficient packaging, securing, marking or addressing, or for the fact or omissions of the recipient or anyone else with an interest in the package. Also, we will not be liable if you or the recipient violates any of the terms of our agreement.
We will not be liable for loss of or damage to shipments of cash, currency or other prohibited items. We shall not be liable for the transportation of bonds, jewelry, precious stones, fine art, bullion, valuable papers or other articles of significant value nor for damage to any article improperly packaged to withstand ordinary handling.
We will not be liable for loss, damage or delay caused by events we cannot control, including but not limited to acts of god, perils of the air, weather conditions, mechanical delays, acts of public enemies, war, strikes, civil commotions, or acts or omissions of public authorities ( including custom and quarantine officials) with actual or apparent authority.
THESE DISCLAIMERS CONSTITUTE AN ESSENTIAL PART OF THIS AGREEMENT. NO PURCHASE OR USE OF THE ITEMS OFFERED BY THIS SITE IS AUTHORIZED HEREUNDER EXCEPT UNDER THESE DISCLAIMERS. 13. Arbitration. Except for actions to protect intellectual property rights and to enforce an arbitrator's decision hereunder, all disputes, controversies, or claims arising out of or relating to this Agreement or a breach thereof shall be submitted to and finally resolved by arbitration under the rules of the American Arbitration Association ("AAA") then in effect. There shall be one arbitrator, and such arbitrator shall be chosen by mutual agreement of the parties in accordance with AAA rules. The arbitration shall take place in Moonachie, New Jersey, USA, and may be conducted by telephone or online. The arbitrator shall apply the laws of the State of New Jersey, USA to all issues in dispute. The controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The findings of the arbitrator shall be final and binding on the parties, and may be entered in any court of competent jurisdiction for enforcement. Enforcements of any award or judgment shall be governed by the United Nations Convention on the Recognition and Enforcement of Foreign Arbitral Awards. Should either party file an action contrary to this provision, the other party may recover attorney's fees and costs up to $1000.00.
15. Controlling Law. This Agreement shall be construed under the laws of the State of New Jersey, USA, excluding rules regarding conflicts of law. The application the United Nations Convention of Contracts for the International Sale of Goods is expressly excluded.
16. Intended For Use Only Within The United States. This site is intended for use only from within the United States. We do not represent that this site is appropriate for use elsewhere. Access to this site from locations where its contents are illegal is not authorized.
17. Onward Transfer of Personal Information Outside Your Country of Residence. Any personal information which we may collect on this site will be stored and processed in our servers located only in the United States. We shall not be liable for damages for any delay or failure of delivery arising out of causes beyond our reasonable control and without our fault or negligence, including, but not limited to, Acts of God, acts of civil or military authority, fires, riots, wars, embargoes, Internet disruptions, hacker attacks, or communications failures.
